1. Acceptance of Terms

By accessing or using TokJox ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, and others who access the Service.

2. Description of Service

TokJox provides a conversational AI platform that enables businesses to create and manage voice agents powered by artificial intelligence. The Service includes voice session management, call recording and transcription, team management, and billing functionality.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information up to date.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws
  • Impersonate any person or entity, or falsely claim affiliation with any person or entity
  • Use the Service to generate spam, harassment, or misleading content
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service in a way that could disable, overburden, or impair its functioning
  • Use voice agents to make calls without proper disclosure that the caller is an AI
  • Record conversations without appropriate consent as required by applicable law
  • Use the Service to process sensitive health, financial, or legal data without appropriate safeguards

5. Subscription & Billing

Some features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. Prices are subject to change with 30 days' notice. Refunds are available within 14 days of initial purchase if fewer than 100 minutes have been used.

Usage Limits

Each plan includes a monthly minute allocation. Usage exceeding your plan's limit may result in service suspension until the next billing cycle or until you upgrade your plan. Usage resets on the first of each calendar month.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by TokJox and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content or data you submit through the Service.

7. Voice AI Disclosure

Voice sessions are powered by third-party AI services (including OpenAI). By using voice features, you acknowledge that: (a) AI-generated responses may not always be accurate, (b) you are responsible for configuring appropriate system prompts and guardrails for your use case, and (c) you must comply with all applicable laws regarding automated calls and AI disclosure requirements.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to provide advance notice of planned downtime. Paid plans include uptime commitments as described in the applicable plan documentation.

9. Limitation of Liability

To the maximum extent permitted by law, TokJox shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless TokJox, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service immediately ceases. You may delete your organization and data at any time through the dashboard settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
